A 42-year-old former Army sergeant was killed when a cement truck crushed the vehicle he was driving. The truck tipped over as it was making a turn due to alleged faulty brakes. He left a wife and two young children. The owner of the cement truck blamed a brake repair facility for the tragedy and the brake company blamed the driver of the cement truck for traveling at an unsafe speed. A settlement of $2,500,000 was eventually reached prior to trial with the cement truck company contributing $2,000,000 and the brake repair facility contributing $500,000. Both settlements equaled the policy limits of the insurance both companies carried.
