A 49-year-old computer specialist sustained serious injuries when he tripped over a wire strung two inches off the floor by a sub-contractor on a building project. The wire was the identical color of the concrete floor and had been installed for the construction of a fence. The client sustained fractures to both arms and wrists, requiring surgery, and was unable to provide for his own physical needs for a two months, relying on his wife for the most basic of bodily functions. He was newly married and the stress of the injuries and lack of income (workers compensation routinely only pays approximately 60% of wages) eventually lead to his new wife filing for divorce. He was off work for almost two years recovering from his injuries, which required two additional surgeries. The claim was eventually resolved for $870,000 of which $80,000 went to his wife for the heartache and emotional distress she suffered as a result of the injuries sustained by her husband. The claims resolved soon after the defendants’ employees admitted in their depositions that they received all of their training and instruction in English yet only understood Spanish.
