A 49-year-old female who worked for an insurance company was injured when her vehicle was rear-ended on the freeway. She did not see a doctor until three days after the accident. She had a history of back problems and the responsible party’s insurance carrier took the position that she had not sustained any new injuries. Russell & Lazarus contacted several top specialists in the area to diagnose and treat the various injuries of which the client was complaining. After a significant medical work up that included MRIs, sleep studies, CT scans and other sophisticated diagnostic tools, it was determined that not only had she sustained new injuries but that the pre-existing injuries were aggravated to the point where pain management was going to be necessary in some form or another for the rest of her life. The insurance carrier, which initially offered nothing on the claim at the beginning, ended up paying $649,000 three days prior to trial at an all-day mediation.
